SCOPE AND ACCEPTANCE

These Terms of Use govern access to and use of the European Gynecology and Obstetrics (EGO) website, available at https://www.egojournal.eu. By accessing or using the Website in any form, you agree to be bound by these Terms of Use. If you do not agree with any of these terms, you should not use the Website.

These Terms of Use apply to all visitors, readers, authors, reviewers, editorial board members, and other users of the Website, regardless of the purpose for which the Website is accessed.

The Website is operated by Edikta S.r.l. on behalf of the European Society of Gynecology (ESG), the scientific society that holds the journal title, the ISSN, and the domain of European Gynecology and Obstetrics (EGO). The relationship between the Publisher and the European Society of Gynecology (ESG) is governed by a Publishing Agreement.

The name European Gynecology and Obstetrics (EGO), the journal acronym EGO, and the journal logo are the intellectual property of the European Society of Gynecology (ESG). Use of these identifiers without prior written authorization from the European Society of Gynecology (ESG) is prohibited.

These protections apply exclusively to the Website Infrastructure. They do not restrict the use of published scientific articles, which is governed by the open access license described in Section 4, nor the use of bibliographic metadata, which is governed by Section 5.

PUBLISHED ARTICLE CONTENT AND OPEN ACCESS LICENCE

European Gynecology and Obstetrics (EGO) is a diamond open access journal. All peer-reviewed articles and other scholarly content published in the Journal are made freely and permanently available under the Creative Commons Attribution 4.0 International license (CC BY 4.0), unless an individual article expressly indicates different terms applicable to specific third-party materials within it.

Under CC BY 4.0, any person may freely share, copy, redistribute, adapt, remix, transform, and build upon published content for any purpose, including commercial use, provided that appropriate credit is given, a link to the license is provided, and any modifications are clearly indicated. The full text of the CC BY 4.0 license is available at https://creativecommons.org/licenses/by/4.0/.

The Journal's Copyright and Licensing Policy, published at https://www.egojournal.eu/policies/copyright-licensing, provides complete information on copyright ownership, author rights, third-party materials, text and data mining, and the irrevocable nature of the open access license.

METADATA, OPEN CITATIONS AND TEXT AND DATA MINING

Bibliographic metadata for content published in the Journal and deposited with Crossref are made available without restriction under the Creative Commons CC0 1.0 Universal Public Domain Dedication. Any person may reuse, redistribute, and build upon such metadata for any purpose, including commercial purposes, without seeking permission.

The Journal participates in the Initiative for Open Citations (I4OC). Reference lists deposited with Crossref are made openly available and may be freely harvested and reused.

Metadata may also be harvested through the Journal's OAI-PMH endpoint in accordance with the applicable protocol. The Publisher may apply proportionate technical rate limits to preserve the stability of the service; such limits do not restrict the substance of the harvesting right.

Articles published under CC BY 4.0 may be subjected to text and data mining, indexing, and computational analysis, including for the purpose of developing or training artificial intelligence systems, without further permission and subject only to the attribution requirements of that license and to any clearly identified third-party rights. Nothing in these Terms of Use restricts the exceptions and limitations provided by Articles 3 and 4 of Directive (EU) 2019/790.

PERMITTED USES

Subject to these Terms of Use, the following uses of the Website are permitted:

(a) accessing, reading, and downloading published articles for personal, educational, or research purposes, in accordance with the applicable CC BY 4.0 license;

(b) printing single copies of articles or other Website content for personal reference;

(d) submitting manuscripts, peer review reports, and related correspondence through the Journal's manuscript management system;

(e) accessing editorial policies, author guidelines, and other information published on the Website for the purpose of preparing or evaluating submissions.

PROHIBITED USES

The following uses of the Website are prohibited:

(a) systematic downloading or bulk extraction of content from the Website that impairs the security, stability, or performance of the Website's servers, or that is conducted for commercial purposes unrelated to scholarly research, without prior written authorization from the Publisher;

(b) use of automated mechanisms to access the Website in a manner that imposes an unreasonable load on the server infrastructure, circumvents technical security measures, or harvests personal data beyond the scope permitted by the Privacy Policy;

(c) use of the Website Infrastructure (including design, layout, graphics, logos, branding elements, navigation structure, non-article editorial pages, and other non-scholarly website materials owned by or licensed to the Publisher or the European Society of Gynecology (ESG) to train, develop, test, or improve artificial intelligence systems, machine learning models, or similar technologies, without prior written authorization from the Publisher;

(d) framing, mirroring, or incorporating any portion of the Website into another website, application, or service without the Publisher's prior written consent;

(e) using the Website for any purpose that is unlawful under applicable Italian or European Union law, or that infringes the rights of any third party;

(f) transmitting, uploading, or distributing any malicious code, virus, ransomware, or other harmful software through or in connection with the Website;

(g) attempting to gain unauthorized access to any part of the Website, the servers on which it is hosted, the manuscript management system, or any connected infrastructure;

(h) reproducing, distributing, or publicly communicating the Website Infrastructure without authorization, in a manner that misrepresents the origin of the content or could damage the reputation of the Journal, the Publisher, or the European Society of Gynecology.

For the avoidance of doubt, the prohibitions in this Section apply exclusively to the Website Infrastructure. They do not restrict:

(i) lawful reuse of published scholarly articles under the applicable CC BY 4.0 license, including text and data mining, computational analysis, and the training of artificial intelligence systems, as set out in Section 5;

(ii) reuse of bibliographic metadata under CC0, as set out in Section 5;

(iii) legitimate indexing, metadata harvesting, citation linking, full-text deposit, or content discovery activities conducted by scholarly indexing services, libraries, repositories, digital preservation services, and comparable services (including Crossref, DOAJ, Scopus, Web of Science, Google Scholar, PubMed, Europe PMC, CLOCKSS, LOCKSS, PKP PN, OpenAIRE, and similar);

(iv) metadata harvesting conducted via the Journal's OAI-PMH endpoint in accordance with the applicable protocol.

USER ACCOUNTS

Where applicable, users with registered accounts are additionally subject to the provisions of this Section. Access to the Journal's manuscript management system requires creating a personal user account. Each account is for individual use only and may not be shared or transferred to any other person.

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You must notify the Editorial Office promptly at info@egojournal.eu if you become aware of any unauthorized use of or access to your account.

The Publisher reserves the right to suspend or terminate user accounts in the event of a breach of these Terms of Use or of the Journal's editorial policies, without prejudice to any other remedies available under applicable law.

Where practicable and appropriate, the Publisher will inform the account holder of the reason for suspension or termination and will provide an opportunity to contact the Editorial Office, unless doing so would compromise security, confidentiality, legal compliance, or the integrity of the editorial process.

USER-SUBMITTED CONTENT

This Section applies to any material transmitted to the Publisher through the Website or the manuscript management system, including manuscripts, figures, supplementary files, peer review reports, Letters to the Editor, Author Replies, and related correspondence ("User-Submitted Content").

9.1 Warranties

By submitting User-Submitted Content, you represent and warrant that:

(a) the content is your own original work, or that you have obtained all necessary rights and permissions to submit it;

(b) the content does not infringe any copyright, trademark, or other intellectual property right of any third party;

(c) where the content includes identifiable patients or research participants, all consents required by the Journal's Research Ethics Policy and by applicable law have been obtained and are retained by you;

(d) the content is not unlawful, defamatory, or otherwise contrary to applicable Italian or European Union law;

(e) any personal data contained in the content has been collected and is transmitted in compliance with Regulation (EU) 2016/679.

9.2 License granted to the Publisher

You grant the Publisher a non-exclusive, worldwide, royalty-free license to store, reproduce, process, transmit, and display User-Submitted Content for the sole purposes of editorial assessment, peer review, production, publication, indexing, and long-term preservation. This license does not affect the ownership of copyright, which is governed by the Copyright and Licensing Policy, and is without prejudice to the CC BY 4.0 license applied to content upon publication.

9.3 Moderation and removal

The Publisher may decline, withhold, edit for form, or remove User-Submitted Content where it is inconsistent with these Terms of Use or with the Journal's editorial policies. Removal of content already published is governed by the Corrections and Retractions Policy; removal of post-publication commentary is governed by the Post-Publication Discussions Policy. Decisions taken in response to a notice under Section 10 follow the procedure set out in that Section.

9.4 Indemnity

You agree to hold the Publisher harmless from third-party claims arising from a breach of the warranties in Section 9.1, save in respect of the Publisher's own wilful misconduct or gross negligence and save for any liability that cannot be excluded under mandatory law.

9.5 Retention

Retention periods for User-Submitted Content and associated personal data are set out in the Privacy and Data Protection Policy.

REPORTING ILLEGAL CONTENT AND INFRINGEMENT OF THIRD-PARTY RIGHTS

This Section implements Articles 11, 12, 16, 17, and 20 of Regulation (EU) 2022/2065 (Digital Services Act) in respect of content hosted on the Website.

10.1 Notice and action mechanism

Any individual or entity may notify the Publisher of content on the Website that they consider illegal by written notice to legal@egojournal.eu. To enable a diligent assessment, the notice should contain:

(a) a sufficiently substantiated explanation of the reasons why the content is considered illegal;

(b) a clear indication of the exact electronic location of the content, such as the URL or the DOI;

(c) the name and electronic mail address of the person or entity submitting the notice, except where the notice concerns offenses referred to in Articles 3 to 7 of Directive 2011/93/EU;

(d) a statement confirming the good faith belief of the person or entity submitting the notice that the information contained therein is accurate and complete.

10.2 Processing of notices

The Publisher will confirm receipt of the notice without undue delay and will process it in a timely, diligent, non-arbitrary, and objective manner. The person or entity submitting the notice will be informed of the decision taken and of the available means of redress. Where content is removed, restricted, or otherwise acted upon, the provider of that content will receive a statement of reasons in accordance with Article 17 of Regulation (EU) 2022/2065.

10.3 Infringement of third-party rights

The same channel may be used to report the infringement of copyright, trademark, personality rights, or patient confidentiality in content published on the Website. Where a report is upheld in respect of a published article, the editorial measures adopted (correction, expression of concern, retraction, or removal) are governed by the Corrections and Retractions Policy.

10.4 Integrity of the scholarly record

Where an article is removed or its availability is restricted, the bibliographic record and the DOI are retained and a public notice is published in accordance with the Corrections and Retractions Policy. The Publisher does not carry out undisclosed or stealth removals.

10.5 Points of contact

For the purposes of Articles 11 and 12 of Regulation (EU) 2022/2065, the single point of contact for Member State authorities, the European Commission, and the European Board for Digital Services, and the point of contact for recipients of the service, is legal@egojournal.eu. Communications may be conducted in Italian or English.

10.6 Liability

The Publisher acts as a provider of hosting services within the meaning of Regulation (EU) 2022/2065 and benefits from the exemptions from liability provided by Articles 4 to 6 of that Regulation. In accordance with Article 7, voluntary own-initiative investigations or measures taken to detect, identify, and remove illegal content do not render those exemptions unavailable.

10.7 Misuse

Where a person or entity frequently submits notices that are manifestly unfounded, the Publisher may, after issuing a prior warning, suspend for a reasonable period the processing of notices from that source, in accordance with Article 23 of Regulation (EU) 2022/2065.

THIRD-PARTY LINKS

The Website may contain hyperlinks to external websites and resources maintained by third parties. These links are provided for informational and reference purposes only. The presence of a link to an external site does not constitute endorsement, approval, or affiliation with the linked content, organization, or service by the Publisher, the European Society of Gynecology (ESG), or the Journal.

The Publisher has no control over the content, availability, or terms of use of external websites and accepts no responsibility for their accuracy, completeness, security, or compliance with applicable law. Users who follow links to external sites do so at their own risk and are subject to those sites' terms of use.

TECHNICAL INFRASTRUCTURE AND SERVICE PROVIDERS

The Website operates on Open Journal Systems (OJS), the open source publishing platform developed by the Public Knowledge Project. The delivery of the service additionally relies on hosting, content delivery, transactional email, and long-term preservation providers, and on the Crossref infrastructure for the registration of persistent identifiers.

Where such providers process personal data on behalf of the Publisher, they act as processors under Article 28 of Regulation (EU) 2016/679 and are bound by written data processing agreements. The categories of provider and the applicable safeguards are described in the Privacy and Data Protection Policy and recorded in the register of processing activities maintained under Article 30 of that Regulation.

CONTINUITY OF ACCESS AND DIGITAL PRESERVATION

Notwithstanding the disclaimer in Section 17, content published in the Journal is deposited with long-term preservation services, including the PKP Preservation Network, CLOCKSS, and OpenAIRE. Persistent identifiers registered with Crossref are maintained so that published content remains citable and resolvable.

In the event that the Journal ceases publication, or that the Website becomes permanently unavailable, published content remains accessible through those preservation services in accordance with their respective trigger arrangements. The Journal's Digital Preservation Policy sets out the archives used, the formats deposited, and the disaster recovery arrangements.

DISCLAIMER OF WARRANTIES

The Website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, the Publisher makes no representation or warranty, express or implied, with respect to:

(a) the continuous availability, uninterrupted operation, or security of the Website;

LIMITATION OF LIABILITY

To the fullest extent permitted by mandatory applicable law, the Publisher shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from:

(a) use of, or inability to use, the Website or any of its content;

(b) reliance on information, data, or recommendations published on the Website;

(d) unauthorized access to or alteration of user data transmitted through the Website.

This limitation of liability does not affect any mandatory rights that users may have under Italian consumer protection law (Legislative Decree 206/2005) or other applicable mandatory provisions of Italian or European Union law, nor does it affect the regime of liability applicable to the Publisher as a provider of hosting services under Articles 4 to 6 of Regulation (EU) 2022/2065.

Nothing in these Terms of Use shall exclude or limit liability for wilful misconduct (dolo), gross negligence (colpa grave), fraud, or any other liability that cannot be excluded or limited under mandatory Italian or European Union law, including liability for death or personal injury. This clause reflects the requirements of Article 1229 of the Italian Civil Code.

DATA PROTECTION

The processing of personal data in connection with the use of the Website, the manuscript management system, and any other service provided through or in connection with the Website is governed by the Journal's Privacy Policy, available at https://www.egojournal.eu/legal/privacy. Users are strongly encouraged to read the Privacy Policy before submitting personal data or creating a user account.

Cookie usage on the Website is governed by the Cookie Policy, accessible via the consent banner displayed on first visit to the Website and available at https://www.egojournal.eu/legal/cookie.

RELATIONSHIP WITH THE JOURNAL'S EDITORIAL POLICY FRAMEWORK

These Terms of Use govern access to and use of the Website. Editorial, ethical, and scientific matters are governed by the specific policies that make up the Journal's editorial policy framework, published at https://www.egojournal.eu/policies.

In the event of any inconsistency:

(a) on matters of editorial process, publication ethics, authorship, peer review, corrections, and scientific content, the relevant specific policy prevails over these Terms of Use;

(b) on matters of access to and use of the Website, intellectual property in the Website Infrastructure, and the legal governance of the site, these Terms of Use prevail;

AMENDMENTS

The Publisher reserves the right to modify these Terms of Use at any time. Amendments take effect upon publication of the revised version on the Website, and each revision is recorded in the version history set out at the end of this document.

Where amendments are material, the Publisher will endeavour to provide advance notice by means of a visible notice on the Website homepage or through the Journal's official communication channels. Continued use of the Website after publication of any amendment constitutes acceptance of the revised Terms of Use.

APPLICABLE LAW, JURISDICTION AND DISPUTE RESOLUTION

These Terms of Use are governed by Italian law, without prejudice to the application of mandatory provisions of European Union law, including Regulation (EU) 2016/679 (GDPR), Regulation (EU) 2022/2065 (DSA), and Legislative Decree 70/2003.

Any dispute arising from or in connection with these Terms of Use, or from the use of the Website, shall be subject to the exclusive jurisdiction of the Court of Rome (Tribunale di Roma), Italy, to the extent permitted by mandatory applicable law. This provision shall not affect any jurisdiction rights granted to consumers under mandatory applicable law, including Article 18 of Regulation (EU) 1215/2012 and Article 66-bis of Legislative Decree 206/2005.

Users who qualify as consumers under Legislative Decree 206/2005 may have recourse to alternative dispute resolution entities registered with the competent Italian authorities, in accordance with Articles 141 and following of that Decree. Recourse to alternative dispute resolution does not affect the right to bring proceedings before the competent courts.

No reference is made to the European Online Dispute Resolution platform: Regulation (EU) 2024/3228 repealed Regulation (EU) 524/2013 and the platform was discontinued on 20 July 2025.

This choice of law and jurisdiction is consistent with the Publisher's registered office and place of business and with the governing law clause adopted in the Journal's Copyright and Licensing Policy.

FINAL PROVISIONS

23.1 Severability

If any provision of these Terms of Use is held to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. The severed provision shall be replaced by a valid provision that most closely reflects its original purpose.

23.2 Waiver

The failure or delay of the Publisher to exercise any right under these Terms of Use shall not constitute a waiver of that right, nor shall any single or partial exercise preclude any further exercise of that or any other right.

23.3 Assignment and editorial succession

The Publisher may assign these Terms of Use, in whole or in part, to a successor publisher in the event of a corporate reorganization, or upon termination or transfer of the Publishing Agreement with the European Society of Gynecology (ESG). Any such assignment shall be announced on the Website and shall not diminish the rights already granted to users under the CC BY 4.0 license, which are irrevocable, nor the accessibility of published content through the preservation services referred to in Section 16.

23.4 Force majeure

The Publisher shall not be liable for any failure or delay in the performance of its obligations under these Terms of Use caused by events beyond its reasonable control, including natural disasters, armed conflict, failure of telecommunications or power infrastructure, cyber attack, or acts of public authority.

23.5 Authoritative language

These Terms of Use are drawn up in English. Should a translation into any other language be published, the English version shall prevail in the event of any divergence, without prejudice to any mandatory right of consumers to rely on a version in the language of their habitual residence.
